1. Acceptance
By creating an account or using Kitobiz, you accept these terms as well as our privacy policy. If you use the service for a business, you declare that you have the authority to bind it.
2. The service
Kitobiz is a tool for tracking invoices, preparing payment reminders and managing client relationships. Reminders and documents are prepared from your data; you remain responsible for their content and for sending them. Kitobiz does not provide legal, accounting or tax advice.
3. Your account
- You must provide accurate information and keep your login credentials confidential.
- You are responsible for the activities carried out with your account.
- Notify us promptly of any unauthorized access.
4. Subscriptions and payments
Some features depend on the plan chosen and are subject to the limits shown in Settings > Subscription. Paid subscriptions are billed in advance, per monthly or annual period, through Stripe, and renew automatically until they are cancelled. You can change plans or cancel at any time from the billing portal; the cancellation takes effect at the end of the paid period.
5. Acceptable use
- Do not use the service in an illegal, fraudulent or misleading way.
- Do not send unsolicited or abusive messages, and comply with the laws on electronic communications (including CASL) and on debt collection.
- Do not attempt to circumvent the security of the service, to overload it or to copy it.
6. Your data
You retain ownership of the data you enter. You authorize us to process it only to provide the service, as described in the privacy policy. You are responsible for having the right to record your own clients' data in the service.
For your clients' personal information, Kitobiz acts on your behalf: the Personal information processing agreement forms part of these terms and sets out our obligations and yours.
7. Suspension and closure
You can close your account at any time. We may suspend or close an account that breaches these terms or puts the service at risk.
8. Limitation of liability
The service is provided “as is”, with no guarantee of continuous availability. To the extent permitted by law, our liability is limited to the amounts you paid during the 12 months preceding the claim, and we are not liable for indirect losses (lost profits, uncollected payments, etc.).
9. Changes and governing law
We may change these terms; in the event of a significant change, we will inform you. These terms are governed by the applicable laws of Québec and Canada.
